Federal Judge Denies the Request to Dismiss Police Brutality Lawsuit

Burlington Township, PA (WBNG Binghamton) A federal judge denies the request to dismiss a lawsuit accusing Pennsylvania State police of brutality - meaning that lawsuit still stands.

The lawsuit claims the officers used excessive force in the arrest Robert Leone back in March of 2010.

Police say Leone was responsible for a hit and run, he led the police on a low speed chase and was acting out of control.

Leone was convicted of simple assault, resisting arrest, fleeing or attempting to elude an officer and an accident involving damage for the hit and run.

He filed a civil suit in federal court in March 2012 against the Towanda Borough and the officers involved.

Leone says he was brutally beaten and assaulted by some Pennsylvania State Troopers and officers.

He also says his civil rights were violated.

Judge Richard Caputo denied the Borough of Towanda's request to dismiss.
