An Irondequoit man has filed a
civil suit against the town's police department, claiming IPD officers used
excessive force during a seatbelt check point back in March.
One of the officers named in
the suit, Jason Hughes, is facing criminal charges in an unrelated case.
Joseph Rivera, 77, claims he
was pepper-sprayed by officers, pulled him from his car and beat him during a
routine seat-belt check at Route 104. The suit also alleges that the officers
never read Rivera his Miranda rights.
Named in the suit are the
police chief, Richard Boyan, Sgt. Jonna Izzo, Officer James Reed and Hughes.
Hughes is currently on paid
leave from the department following an assault charge related to an incident
Memorial Day at a Rochester bar.
Rivera is seeking damages and
attorney costs.
Irondequoit police say they do
not comment on pending litigation.
