Cop who had sex on car sues state



ALBUQUERQUE (KRQE) - The State Police officer caught having sex in uniform on the hood of his patrol car, while his Chihuahua looked on, is seeking unemployment benefits claiming he should not have been fired.

According to court records obtained by KRQE News 13 Bert Lopez claims he was fired after the incident , although a spokesman with NMSP says Lopez resigned his position before he could have been fired.

Images of Lopez having sex with a naked woman on his patrol car with a Chihuahua watching, went viral and became late-night fodder for talk show hosts.

According to court documents, Lopez filed a petition for unemployment in District Court in Sandoval County March 29th.

In the documents, Lopez says he was wrongfully terminated because he'd never been in trouble before. He also claims the State Police Department lied during the firing process.

Workforce Solutions and State Police say neither agency has been served with any papers regarding the issue. A court employee says it's up to Lopez to set a hearing date and serve the agencies with the documents.

News 13 called Lopez but he did not return our calls. State Police and Workforce Solutions did not want to comment on the case.

A state official told News 13 it's very rare for someone to get unemployment benefits when they're fired for just cause, or when they voluntarily leave a job.
